Nemaco Technology, LLC offers enclosure (and other product) dimensional acad in the form of prints or files to customers, engineers and/or sales representatives for convenience when working on projects. The customers,engineers and/or salesman acknowledge that Nemaco Technology, LLC enclosure (and other product) acad, prints and files are the property of Nemaco Technology, LLC. Therefore customers (and any potential customers), engineers and/or resellers do "not" own the acad, prints and/or files regardless if they purchased or did not purchase a product from Nemaco Technology, LLC. Furthermore, customers, engineers and/or resellers shall "not" copy, duplicate and/or sell any of Nemaco Technology, LLC acad prints or files.

30 DAY TIGER PRODUCT WARRANTY
NEMACO TECHNOLOGY, LLC AGREES TO REPLACE AND/OR REPAIR ANY "STOCK" PRODUCTS WITHIN 30 DAYS. BOTH "STOCK" AND "CUSTOM" PRODUCTS CAN "NOT" BE RETURNED WITHOUT NEMACO TECHNOLOGY, LLC RETURN MATERIAL APPROVAL (RMA). ALL "CUSTOM" PRODUCTS ARE SOLD "AS IS" AND CAN "NOT" BE RETURNED BUT NEMACO TECHNOLOGY, LLC WILL OFFER TO REPAIR THE PRODUCT IF RETURNED IN 30 DAYS. THEREFORE, NEMACO TECHNOLOGY, LLC SHALL OFFER TO REPAIR AND/OR REPLACE ANY DEFECTIVE GASKETS AND/OR MECHANICAL HARDWARE FREE OF CHARGE WITHIN 30 DAYS AFTER BEING SHIPPED TO THE CUSTOMER.

CUSTOMER PRODUCT INSPECTION REQUIRED
NEMACO TECHNOLOGY, LLC REQUIRES THAT ALL CUSTOMERS, ENGINEERS AND RESELLERS MUST IMMEDIATELY INSPECT PRODUCTS AFTER RECEIVING ANY NEMACO (TIGERBOX) PRODUCTS. CUSTOMERS MUST NOTIFY NEMACO TECHNOLOGY, LLC OF ANY DEFECTIVE PRODUCTS AND/OR PRODUCT ORDER CORRECTIONS WITHIN 15 DAYS. IT IS UNDERSTOOD THAT THE PRODUCTS ARE BEING SOLD "AS IS" TO THE CUSTOMERS.

DISCLAIMER
NEMACO TECHNOLOGY, LLC HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES EITHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE BY THE CUSTOMER. NEMACO TECHNOLOGY, LLC HAS NO CONTROL OVER THE USE, MISUSE AND/OR TAMPERING OF A PRODUCT BY THE CUSTOMER. THIS DISCLAIMER BY NEMACO TECHNOLOGY, LLC IN NO WAY AFFECTS THE TERMS OF THE NEMACO'S AND/OR ANY OTHER MANUFACTURER'S WARRANTY FOR PRODUCT REPAIR AND/OR REPLACED, IF ANY APPLICABLE.

LIMITATION OF LIABILITY
NEMACO TECHNOLOGY, LLC WILL NOT BE LIABLE FOR LOST PROFITS, LOSS OF BUSINESS OR OTHER CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY EXCEPT AS EXPRESSLY PROVIDED HEREIN. NEMACO TECHNOLOGY, LLC WILL NOT BE LIABLE FOR PRODUCTS OR SERVICES NOT BEING AVAILABLE FOR USE OR OTHER NON-RELATED NEMACO PRODUCT FAILURES. CUSTOMER AGREES THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCTS OR SERVICES, NEMACO TECHNOLOGY, LLC IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AGGREGATE DOLLAR AMOUNT PAID BY CUSTOMER FOR THE PURCHASE(S) UNDER THIS AGREEMENT. AGAIN, THE CUSTOMER IS RESPONSIBLE TO INSPECT ALL NEMACO (TIGERBOX) PRODUCTS BEFORE ANY USE. NEMACO TECHNOLOGY, LLC TRIES TO PRODUCE QUALITY PRODUCTS BUT ALSO THE CUSTOMERS, ENGINEERS AND/OR RESELLERS HAVE THE RESPONSIBILTY TO INSPECT PRODUCTS BEFORE USING THEM AND/OR RESELLING THEM. ALSO, CUSTOMERS, ENGINEERS AND/OR RESELLERS ARE REQUIRED TO NOTIFY NEMACO TECHNOLOGY, LLC OF ANY DEFECTIVE PRODUCTS SO THEY CAN BE REPAIRED AND/OR REPLACED. AS ALWAYS, NEMACO AGREES TO REPAIR OR REPLACE DEFECTIVE PRODUCTS WITHIN THE PRODUCT GUARANTY AND WARRANTY AGREEMENT. THERE SHALL BE NO EXCEPTIONS. THE PRODUCT GUARANTY AND WARRANTY IS COMPLETELY VOID IF ANY OF NEMACO TERMS AND CONDITIONS ARE NOT ADHERED BY CUSTOMERS, ENGINEERS AND/OR RESELLERS.
